Reproduction, distribution, modification, or commercial use of any content without prior written authorisation is prohibited and may constitute an infringement of DRC intellectual property law and OHADA protections.

The Moon Plast diamond logo and wordmark are trademarks of Moon Plast in the DRC and may be protected in other jurisdictions. Unauthorised use is strictly prohibited.

5. Applicable Law and Regulatory Framework

This Site and the company are subject to the following legal frameworks:

• DRC Digital Code — Loi n° 23/010 du 13 mars 2023 (electronic communications, cybersecurity, digital transactions, data governance)
• DRC Constitution (Article 32 — right to privacy; Article 34 — freedom of enterprise)
• OHADA Uniform Acts — applicable in the DRC since September 2012; governs commercial company law, general commercial law, and business obligations
• African Union Malabo Convention on Cyber Security and Personal Data Protection (DRC authorised ratification December 2022)
• GDPR (EU Regulation 2016/679) — applied to the extent the Site processes personal data of persons located in the European Economic Area
• DRC Commercial Code and applicable tax regulations enforced by the Direction Générale des Impôts (DGI)

6. Regulatory Authority

Electronic communications and digital services in the DRC are regulated by the Autorité de Régulation de la Poste, des Télécommunications et des Technologies de l'Information et de la Communication (ARPTIC), formerly ARPTC.

Commercial activities are subject to oversight by the competent Tribunaux de Commerce in the DRC and the OHADA Common Court of Justice and Arbitration (CCJA) for cross-border disputes.
