1. Acceptance of Terms

By accessing or using the Moon Plast website at moonplastdrc.com (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site. These Terms are governed by the laws of the Democratic Republic of Congo (DRC) and, where applicable, OHADA uniform acts in force.

Moon Plast reserves the right to update these Terms at any time. Continued use of the Site after any revision constitutes acceptance of the updated Terms.

2. About Moon Plast

Moon Plast is a plastic products manufacturer registered in the Democratic Republic of Congo. The Site is an informational and commercial communication tool — it does not currently constitute an online store or binding offer of sale. All product orders and pricing are confirmed directly through our sales team.

3. Permitted Use

You may use the Site to:

• Learn about Moon Plast products, services, and the company
• Submit inquiries, order requests, or partnership proposals via the contact form
• Download any content we expressly make available for download

You must not:

• Use the Site for any unlawful purpose or in violation of DRC law, including DRC Digital Code Loi n° 23/010
• Attempt to gain unauthorised access to any part of the Site or its underlying systems
• Transmit malicious code, spam, or any content that is defamatory, fraudulent, or harmful
• Scrape, crawl, or systematically extract data from the Site without our prior written consent
• Impersonate Moon Plast or any of its employees or representatives
• Use the Site to send unsolicited commercial communications
• Reproduce, duplicate, or resell any part of the Site without express written permission

4. Intellectual Property

All content on the Site — including the Moon Plast name, logo, product images, text, graphics, page layout, and software — is the property of Moon Plast or its licensors and is protected by copyright, trademark, and other intellectual property laws applicable in the DRC and internationally.

You may view and print pages from the Site for your own personal, non-commercial reference only. No content may be reproduced, distributed, modified, or used for commercial purposes without our prior written consent.

5. Contact Form and Inquiries

When you submit a contact form inquiry you confirm that:

• The information you provide is accurate and complete
• You are authorised to make the inquiry on behalf of any business you represent
• You have read and accepted our Privacy Policy

Submission of the contact form does not constitute a binding contract or order. All orders are subject to a separate written agreement or order confirmation from Moon Plast.

6. Product Information and Accuracy

We make reasonable efforts to ensure product descriptions, dimensions, and images are accurate. However, product specifications may change without notice. Colours displayed on screen may differ from actual product colours due to display calibration. For confirmed specifications, please contact us directly.

7. Disclaimers and Limitation of Liability

The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by DRC law.

Moon Plast does not warrant that:

• The Site will be available at all times without interruption or error
• The Site is free from viruses or other harmful components
• Any information on the Site is complete, accurate, or current

To the maximum extent permitted by applicable law, Moon Plast shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability to you shall not exceed USD 100 or the equivalent in Congolese francs at the applicable exchange rate.

Nothing in these Terms limits or excludes our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by DRC law.

The Site may contain links to third-party websites. These links are provided for your convenience only. Moon Plast has no control over and accepts no responsibility for the content or practices of any third-party sites. Linking does not constitute endorsement.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Democratic Republic of Congo, including applicable OHADA Uniform Acts. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to the competent courts of the DRC.

For disputes involving parties in OHADA member states, either party may elect arbitration under the Common Court of Justice and Arbitration (CCJA) rules.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
